Intellectual Property Rights of Associations

The protection of intellectual property rights of associations and solidarity projects/causes registered on ShopDonation is one of the founding principles of the platform.

The associations registered on the platform do not grant ShopDonation or its partner merchants the right to use their image.

Donations to associations are generated by users who choose to use the ShopDonation platform. There is no commercial relationship between the merchants and the associations.

When a donation is generated, there are four contractual relationships involved:
- The user who makes a purchase on the merchant's website (outside ShopDonation site and its jurisdiction). This is a simple sales contract between the two parties.
- The merchant website pays a commission to ShopDonation. This is a simple sales commission contract.
- Between ShopDonation and the user, there is a mandate contract where ShopDonation provides a technical solution and handles the donation payment to the user's chosen association.
- Between ShopDonation and the association, there is a simple service provision where ShopDonation allows associations to register and benefit from the platform system.

Therefore, it is not the stores that generate donations, but the users of the platform. Partner merchants do not have the right to use the image of associations registered on ShopDonation.
